Strata corporations are essentially democratic organizations, but sometimes the will of the majority needs some help. Gehlen Dabbs has represented several strata corporations facing major “leaky condo” remediation work, where the required ¾ vote of members has not been obtained. In these situations, a court application is necessary to empower the strata council to raise the required special levy and to carry out the required work to fix the problem.
Court-appointed administrators may be appointed over a strata corporation in a number of situations, typically where the affairs of the strata corporation are being conducted in a way that is unfair to some of the strata lot owners.
